An Ebuyer customer paid for next-day delivery over the Christmas period and didn't get his PC until a few days later. Has the company misled the customer?
I ordered a desktop computer, a widescreen monitor and some free anti-virus software from Ebuyer on Christmas Day. Believe it or not it was offering next-day delivery. I paid £11 extra for this and then it turned out that it would be delivered on 30 December. But only the monitor and software arrived.
City Link said the computer should come the following day but it didn't. I emailed both City Link and Ebuyer and even tried calling both companies. But I have had no luck in talking to anyone or getting a response to my emails.
Ian Birch
We have to admit we would have been very wary about believing in any next-day delivery offer over the holiday weekend. However, by taking payment for the extra delivery, Ebuyer has misled Mr Birch; albeit, we are sure, completely unintentionally.
He also asked if we could find out where the computer was. Mr Birch told us that it was a good deal and he would rather have the PC than a refund.
So we tracked the City Link job number and it did say the PC had been put on a van for delivery. We were delighted to find that the computer was delivered the very afternoon we checked.
We have also contacted Ebuyer and asked it to refund Mr Birch the £11. This is because, although it was highly unlikely that he would get delivery on a Sunday, and one that was a holiday as well, the company did take the money. He therefore paid for a service that he didn't get and so is entitled to have this money refunded under the Supply of Goods and Services Act 1982.
